Terms and Conditions of Service

1. Scope of Work

All services provided will be as outlined in the agreed quote or service description. Any variations or additions must be approved by both parties in writing and may incur additional charges.

2. Access and Site Conditions

Clients must ensure clear and safe access to the worksite on scheduled days. Any delays caused by restricted access, unsafe conditions, or interference may result in additional charges. Pets must be secured away from the work area unless otherwise agreed.

3. Underground and Hidden Services

It is the client’s responsibility to clearly identify and inform Touch of Nature Gardening Services, in writing, of the presence and location of any underground or hidden services, including but not limited to: irrigation systems, power cables, drainage, gas lines, water pipes, and telecommunications cables.
We will not be liable for any damage to such services not clearly identified by the client prior to work commencing.

4. Client-Provided Tools, Equipment, or Vehicles

Where the client requests or allows the use of their own tools, vehicles, or other equipment during the course of our work, this is done entirely at the client’s own risk. We accept no liability for any loss, damage, or malfunction of client-owned items.

5. Liability and Damages

While all care is taken, Touch of Nature Gardening Services will not be liable for:

• Incidental or consequential loss or damage to property, garden structures, existing plants, or other assets unless due to proven negligence.

• Delays due to weather, supply issues, or other circumstances beyond our control.
  
  

Our total liability (if any) will be limited to the value of the work undertaken under the specific contract or service.

6. Health & Safety

We follow all reasonable health and safety practices. Clients must notify us in advance of any hazards on site, including aggressive animals, dangerous terrain, or chemical use.

7. Payments and Invoicing

Unless otherwise agreed in writing:

• Full payment is due within the agreed timeframe specified in the quotation/invoice.

• Late payments may incur interest at 2% per month and/or collection costs if debt recovery is required.

• For larger jobs, a deposit or staged payment schedule may apply.
  
  

8. Plant Supply and Establishment

Plants supplied are selected with care and suitable to local conditions; however, we do not guarantee plant survival once installed due to factors outside our control (e.g. watering, pests, weather). Aftercare guidance will be provided, and additional plant replacement may be offered at our discretion and cost.

9. Weather and Scheduling

All work is subject to weather conditions. In the event of unsuitable weather or unforeseen delays, we will reschedule at the earliest available time. We are not responsible for any costs or damages arising from schedule changes.

10. Cancellations

Cancellations must be made at least 48 hours prior to scheduled work. Cancellations with less notice may incur a fee to cover lost time and costs.

11. Ownership of Materials

All materials, including plants and supplies, remain the property of Touch of Nature Gardening Services until full payment is received.

By accepting a quote, booking our services, or allowing work to proceed, the client is deemed to have accepted these Terms and Conditions.
